- In all misdemeanor cases including criminal contempts in
which an appeal has been noted from the final judgment of any
district court, trial of such appeal shall be set on that
Misdemeanor Appeal Day of the Circuit Court to which the appeal
lies next succeeding the expiration to twenty days after the date
of conviction. District Courts shall promptly transmit the papers
of the case to the clerk of the Circuit Court after the expiration
of ten days from the date of conviction. Cases set for trial on a
Misdemeanor Appeal Day which for any reason are not tried on
that day shall be continued by order to a day certain.
- If a Term Day of Grand Jury Day intervenes between the
transmittal of the papers by the District Court to the Circuit
Court and the Misdemeanor Appeal Day on which the case is set for trial, then all motions, pleas or other matters preliminary to trial shall be presented on such day; and if such day does not intervene then the same shall be presented at any time available to the Court prior to such trial.
